    Reaffirmation

    I know this may be a simple question to most but I wanted to post it to see what the answer may be.

    We plan on reaffirming our 2 cars, 1 small CC bill, and our house (the CU that holds these debts is also my wifes employer). We are current on all of these and the CC is probably cross-collateralized. We filed about 2 weeks ago and during the process all the way through the discharge we plan to stay current.

    From what I read the Trustee likes to ask if we have made any payments to our creditors over the last 90 days (typically over $600) and the answer to that question is going to be yes. Does it make a difference that we plan on reaffirming these debts?


    One other note. We pay a nanny $500 monthly to watch our 6 month old kid. We pay her directly. Is that considered a insider payment? This nanny does not know we are filing bankruptcy but I am sure I can get her to write a letter stating that she is being paid to watch our son.

    You are making payments on secured debts like the mortgage and cars. That's fine. The probition you refer to deals with unsecured debts like, credit cards, medical bills,etc.

    As long as the nanny isn't a friend or relative, paying her is no issue.

      Hmm... She is a friend since she actually watched our first child during his first year. I wonder how that will go.

        Well she became a friend after watching your first child. Correct ? Not sure how they would prove you socialize with this person.

        Also, the small cc that you will continue to pay, won't the other cc consider that preferential treatment ? It's not a secured debt.
