    Can they call at work?

    I am trying like hell to keep our BK from my employer. My question is: Can our creditors call at work? I looked at the contact number we used for one of our cards and it's my husband's old work number. Do they have to use that number or can they call around looking for you?
    After reading all the posts on this forum, I am considering letting next month be the first month that we stop paying our credit cards. However, my husband does not respond well to these kinds of pressure calls, and I don't want that kind of stress coming down on him at work. Is there any way I can cut them off at the pass, call them and tell them not to call at work.
    We have yet to retain an attorney, but I hope to find one in the next couple of weeks.
    Any help would be much appreciated!

    Pull out the information that you were provided at the time you signed for your credit cards (brochures, attachments, etc.). When you applied for the card or were approved, you had available or were given a copy of the contract/agreement you signed. In that paperwork is what you agreed to when you accepted the credit. Read through it...it tells you all that you allow them to do if you do not pay, breach the contract, etc. The best thing to do to avoid them calling at work is to make sure you are reachable at home. They will only call other numbers you provided them if they cannot reach you. If they do call at work, advise them your employer does not allow personal or non-work related calls at work.

      They are permitted to call you at work, however, they cannot say anything as far as trying to collect debt or anything like that. I would write them, certified with a return receipt, and advise them that work calls are not permitted.

      Flamingo is right that they will not call your work if they can reach you at home. Though I had one call one hour after they left a message on my home machine.
      I may be smarter than an attorney, but I'm not one. No legal advice here, people.

        if you can, get online and remove all your work related numbers from your accounts! They will call around for you. If you put your closest relative on your credit applications they can (and will) call them as well...

        And even when they don't say they are trying to collect a debt, its pretty obvious when they leave a message with your secretary "yes, can you tell them that Jodi from Bank of America called and we've been trying to reach them and can't. Can you tell them to call back ASAP at this number ext. 216".

        And even though we told creditors DH is not allowed calls at work (he works off site, so when they call the office he actually has to leave the work site and come into the office, I didn't even call his office when I went into labor!!! I waited until I could reach his cell) they still called...

            I hate to disagree with Flamingo whose opinions I hold in the very highest of regards, but make no mistake: quite a few creditors - even if they can reach you at home - will call you at work, for sheer harassment and to put pressure on you.

            GMAC got to my boss at the time a couple of years ago (I honestly never figured how they got the number, made no sense to me then and still doesn't, but anyway) and he very politely told them that he has no clue what they want or where they got the number from, but that he knew for a fact that it wasn't from me since I was well aware that personal phone calls were not allowed whatsoever...they shut up after that, real quick, never called the work again...and once again, the number that they had called was NEVER provided by me when I signed the loan.

            It was a non-published number, in a different building, with a different area code.

            The original number that they were given at the loan signing was disconnected soon after and was providing no additional information at the time...

            So count on some - not all of them - going an extra mile or two or seven to get to you...

              I kinda thought that would be the answer from everyone. I am setting up an appointment with an attorney for the first part of June and hope to have all the paperwork in order by the end of the month (am I being optimistic???). I hope that we can file by August. Do we determine when to file or does the attorney???

                you are the one who decides everything about filing. the attorney is supposed to do what you decide (based on advice from him of course), but the precise filing date will also depend somewhat on the attorney's schedule and other clients coming before you.
