    Withdrawing from account without authorization

    My attorney told me that without a judgement against me, creditors were NOT allowed to withdraw from my account, even the one owed where I also had my checking account. I moved the account to another bank just to be sure that my funds weren't seized or frozen.

      Banks have the right of set-off, which allows them to take money from your accounts if you owe them money. This right is unrelated to them needing to get a judgment against you. That was smart to move your money out of an account with a bank you owe money to.

        That is only true for banks and CU's where you have a laon and a checking/savings account though, right?

        CC companies may not do that, correct? I pay almost all my bills on (NOT auto pay, one time payments) and I was worried that they may use past transacions to get my bank info and debit the payment from the account I used to pay them with (checking)....

          I'm worried about this too. I have no loans at the bank where my checking account is, BUT I pay all my bills through online payments - my checking and routing number, not my debit card number. My checking account number is saved in their system, which I could remove, but know realistically, it's still saved somewhere. I'm just worried about them taking money from the account when I stop paying the bills, which is happening next month.

            I stopped paying my cards less than a month ago....barely 3 weeks late on a few of them and the calls started last week! I've talked to 4 different creditors so far. One called today but I was sleeping and didn't talk to them. I'm hoping to get filed by Friday!

              Yes I agree 100%. As long as you have money somewhere you don't owe money to, the right of set-off doesn't come into play. Credit card companies cannot do this, unless for example you have a checking account with Bank of America and also have a BoA credit card.

                Did they stop calling once you talked to them? Did you tell them you were going to file BK?

                  once i told them i was filing bk and gave them my lawyers info the calls slowed down some. they will still call until you file and get a number.

                    I got a lot of credit cards. I did some research and you can send them a cease and desist letter. Just say that you want all calls to stop and to only be contacted through mail. After they receive the letter they cannot make any calls to you or you can sue them. But you have to do it for all your creditors.
