    Tax return question

    I'm collecting my paperwork together for my bankruptcy and I'm missing my 2008 tax returns because they were destroyed in a flood that hit my home. I told my attorney this and he told me that we can work around this using my 2009. Have any of you heard this? I thought the last 2 years tax returns were needed.

    If it is needed, is there anyway to have a copy the 2008 tax returns expressed to me from the IRS? I think I need an exact copy and not a transcript.

    You can call the IRS and get a free "transcript" of any tax return! The transcript is sufficient for bankruptcy purposes. Just make sure your requested transcript is for all forms and schedules.

      You can always get your Tax Return transcript from the IRS. You DO NOT need an exact copy.

      The bare minimum is the most recent tax return, Section 521(e)(2)(A)(i).

      You will be fine. You only need to provide prior years tax returns (aside from the most recent year) if requested. Most attorneys will ask for 2-3 years of tax returns as part of their analysis of your case.

        We were asked for 2005 to current for our impending BK13 AND IRS transcripts.

        I thought that was weird...

          I think they ask for more years (4-5) when you are filing a Ch 13. ...at least in my area they do.
