    Using the Calif. wild card exemption for $22K cas

    Can I use the Calif wild card exemption to protect the approx 22K I have in cash if I am a renter. It says under CCP 703.140 (b) (5) "The debtor's interest, plus any unused amount of of the exemption under paragraph (1), in any property." It says under Paragraph (1) "The debtor's aggregate interest in real property that the debtor uses as a residence", etc. - I don't own, I rent an apartment - Can I still get the full approx $23K "wild card" exemption allowed for people that own their residence (or RV or boat, etc. that they live in) if I keep on renting or should I go and buy an RV to live live? If you really don't know the answer please don't answer this thread

    Yes. i filed under Ca system 2 and exempted a car, a 32" Toybox trailer, 3 Quads, and a small utility trailer.

    however you may not be able to exempt all that cash,I believe the Wild card is a little over 20K

      Yes, wildcard covers cash. Keep in mind your other assets as well. If you're over the auto exemption, household goods exemption, etc. all that has to come from the wildcard. You may need to spend down a couple thousand before filing just to be sure it's completely safe....
      Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11

        Yes we used it for two motorcycles, the truck we almost owned, etc. Also, on the truck and my husband's mechanic tools (his a motorcycle mechanic so about $10K worth) we were able to use both the "tools of the trade" and the rest from the wildcard exemption.
