    Schedule I & J Questions

    Hi all,

    These questions may already be addressed within the forum so forgive me for jumping the gun but I'm sooooooo close to filing and I'm just anxious about a few things.

    I currently receive $359 in Supplemental Nutrition Assistance Program (Food Stamps) and WIC (no cash value amount - just items listed). I'm trying to see what everyone else is doing when it comes to adding these to Schedule I. I believe the SNAP goes on #11 of Schedule I - do I/can include WIC? There's no actual cash value.

    Regarding schedule J - I currently don't pay rent. Well, I live in a home that was rented to me by family members, then I started working for said family member and my rent was then included in my compensation - but it is not paid out to me in a check and then docked from my pay. It was a simple agreement. If I leave this a 0 will this cause problems or do I just explain it to the Trustee during our 341? Also, since student loans are not discharged I do include them on my Schedule J if I intend to keep paying for them right?

    I fall beneath the median for a household of 3 but my Schedule J shows that I have about 300 left over every month. Problem?

    With a positive $300, you won't be filing Chapter 7. You will have to go with a Chapter 13. Are you sure that you have looked at all expense categories?

      So is it the food stamps tipping you into the positive? I'm not sure they can force you into a ch.13 based on you receiving government assistance. However, if it makes that much difference, it may be worth it to discontinue the food stamps for a couple months so that you can file ch.7 and then sign up for them again once your bk is discharged....

        Thanks Helpmeout-I'm going to have to really take a look at some expenses as I didn't put any on clothing or entertainment thinking I shouldn't allot money for that and because I haven't spent anything on clothing or entertainment as there are no funds

          Thanks momofthree-the SNAP is actually noted as income and I allot an extra 150 a month for my food expense + what I get from SNAP on my Schedule J so I don't think that's it. Just have to take a look at my expenses again.

            If you're under the median i don't think the trustee will care. Once I do my schedule J I'll be in the positive by over a grand but my lawyer seems to think I can still do a 7. He said I will eventually need to move out and get my own place, etc.

              Thanks nc73 - I keep hearing our Trustee here is not as critical if you are under the median. We'll see...
