    Reaffirmation concerns, I have a question

    I live in FL, filed a ch.7, and already had the 341. I recieved a letter from my attorney saying everything went well, and I should most likely reach the discharge without any complications.

    Note: My income was over the median and I initially failed the means test, but because of my expenses I was able to squeeze into a 7 versus a 13, although barely.

    Another Note: Bank I am reaffirming with is same bank who I have/had a $10k credit card with, and also my 1st mortgage, which I am foreclosing on.

    I am considering reaffirming my automobile. My lawyer suggested that I do not reaffirm, but I do fear the chance they repo the car, even though I continue to make payments on time.

    I am filling out the paperwork to reaffirm, and I have to state my income and expenses. Can this have any effect on my Ch.7, in the sense if I show the court that I can now afford the car, is there a chance they can push me into a 13 at this point?

    Since your lawyer advised against reaffirming, but you are continuing to make the payments and on a timely basis, I would go with your lawyer's advice. Some institutions insist that you reaffirm, but it appears that yours doesn't. As long as you keep your payments current, I don't think you will have any trouble. Good luck!
