I've had one phone consultation with an attorney so far, and he told me that they look at your last six months of income to determine eligibility to file a Chapter 7. I've been receiving unemployment for the last couple of months, and my husband's company has not made any money this year. So, my question is, if he gets a full-time job before we file, will they look at the average of what we made in the past six months, or what we are earning at the time of the filing and going forward?
Also, I'm filing alone since the bills are all in my name, so will they still take into account my husband's salary? And unemployment compensation is listed as exempt for VA, so would that not count toward income or does that just mean that they can't take it? Thanks so much for your help!
