    Phoenix BK lawyer - need your assistance

    I have sat with almost a dozen BK attorneys in the Phoenix area and have found a handful who seem to know the law very well. However, I am having difficulty finding one who will assist in pre-BK planning and strategy. It seems that, in this market and time, they are simply interested in moving through a BK as quickly as possible, taking little time to analyze or structure any pre-BK conditions.

    I know that BK law is pretty black and white, but I would like some pre-BK assistance in making my filing as smooth as possible. The last thing I want is a Trustee tearing me apart because I failed to plan ahead for avoiding issues. Almost all the attorneys I have spoken with seem to want to avoid talking "strategy" and making recommendations. Most speak only in boilerplate terms. My case is hardly "boilerplate", but I would sure like to have an attorney who can help me fit that description within a few months.

    If you have any recommendations for a strong attorney with a keen sense on how to navigate the BK waters in the Phoenix area, I would love to receive your Private Message (please do not attempt to post them here, per forum rules).

    Best of luck to you. Had my FIRST attorney done some BK strategizing with me, I would not have found myself in the predictament I was in having to have a total of 3 attorneys. It cost a fortunate (not a small one either) more to undo all that occurred.

        Back the horse up there cowboy. That assumption is patently false. If there is any area of law that is NOT black and white, it is bankruptcy. Reason being, no one really has the resources in the BK environment to take things very far up the judicial ladder. Even within a district, individual BK judges take a different view on various issues within BK. As with any legal case, the issue come down to the FACTS, not the law. Facts vary from case to case.

        Here is the thing, no attorney is going to do pre BK planning AT THE CONSULTATION. So the most you will get from ANY attorney is boilerplate answers until they sit down with the details of your information, which, of course, you need to pay for.

        If you really want pre-bk planning, you will need to pay for it. attorneys that charge less than $2K generally will not offer any meaningful pre BK planning beyond standard, boilerplate info.

          In the 10 months since I made that post, I learned exactly that - lots of gray, and a good attorney costs $$$ but is well worth it.

          AFter a lot of consultations, I found a GREAT one who helped us manage this process - received discharge Nov 30.

              I tend to not agree with the whole "higher price-better lawyer" thing. I am only commenting because this is the second post I have seen today on the price of an attorney's fees equating to his worth in regards to a BK case. The more expensive an attorney is, the more he can brush you off because he has 2500 other cases. You turn into a number. I went and saw a high buck attorney and got nowhere NEAR the advice, time or knowledge that I did with my patient attorney that took care of every minute detail of my case-AND he was $700 cheaper.

              I guess it depends on what exactly you value when looking for a lawyer- Quantity or quality.

                I tried to do what you are now. You're the best resource for yourself at this moment - imo. Reading the archives (by keyword search) on this forum will likely give you all the strategizing you need. I found it best to walk in to the attys office and say "I want to do xyz". When I was putting the ball in their court, they wanted the path of least resistance, not necessarily what was in my best interest.

                    Not to rehash an old post - can you PM me your atty's details. I have felt really comfortable with an of the atty's i've met with yet.
