If I have checked the box to surrender a secured property does the bank have to get the stay lifted to proceed with a trustee sale ? Thanks in advance.

Everyone has the benefit of the automatic stay. (Assuming you have not recently filed & been dismissed. In that situation, when you refile you may have a limited automatic stay.)
So yes, they must file to lift the stay or wait til discharge.Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)
