    I want to move back to New York

    I am in the middle of a Chapter 13 BK. My case was converted from a Ch 7. I was 15 minutes late for my Ch 13 341 meeting, so it has to be rescheduled. Meanwhile, the confirmation hearing for the 341 is on the 26th of this month.

    One of the major issues in my case is a moving company that is holding all of my furniture and other belongings in Edison, New Jersey until I pay them about $7,000. $4600 of that being for the move from New York to Georgia, and the rest being back storage fees at $330 per month.

    I have had enough, especially because the jobs pay way too little down here, and all of my friends are in New York. My best friend is going to let me stay with her, which will save on my rent for awhile, and I will more easily be able get my things back, which is all I want.

    I want to move as soon as I get my paycheck (from Substitute Teaching) at the end of this month. So, now what? Can I move in the middle of a bankruptcy case?

    The car people filed a Motion for Relief from Stay, and I attended the hearing on the 12th (Thursday). Their attorney and I have a pretty good rapport (I'm Pro Se), and she told me that since I missed the Meeting of Creditors, they will need to reschedule it. In order to give all the creditors enough notice, the earliest would probably be in April. Can they transfer the case to the New York BK Courts, or do I have to come back down here in April to attend the hearing? This is really important....I'm at the end of my rope with these rip-off moving companies.

    a case cant be transferred that i know of. its a different set of rules, different trustees, different attorney for the creditors, etc. that would be a great ploy to foul them all up though hehe.

    you can move yourself, anywhere you want. your only requirement is to show up for the required court appointment and supply the court with what it requests. you can even move to africa if you want. just be sure to show up to court when scheduled.

      Well, I guess that makes sense. Well, I'm going to the Confirmation Hearing on the 26th. I wonder if I should tell them I'm moving? I guess I will need to because I will need to be served all notices and motions that are filed in regards to my case.

        yes you have to inform the court via paperwork (lol) that you are moving. they dont care much. they only care if the judge or trustee makes a date with you and you stand them up. they are overly sensitive.
