    Dell Financial small business credit acct -advice please

    I got a Dell small business financial account last June - and have $2300 balance on it - stupidly i charged 1200 on it in march - I dont know what i was thinking, but assuming it was only created under my EIN i would just pay it off and not have to declare it in BK -

    I wont be filing for about 6 more weeks, but realize Dell is secured, I wish I could just return the system i got on charged on 3/7(delivered on 4/1) but it is too late -

    I dont have an appt with my atty scheduled until i am ready to file the papers.

    I am continuing to make the minimum payment on this, some of my personal cards are 90 days late now, some i have just missed the first payment.

    Advise and thoughts please - I of course will go over it all with my atty when i see her again, but what are you thoughts?

    it will be listed right?

    as a secured acct will it delay things?

    because i have made a purchase so recently i am screwed?

    can i just reaffirm it and not worry about it?

    I have a sole proprietorship - the EIN is from my business that is no longer in business. When i created the acct i didnt think I would be going BK

    i think i need anxiety meds, i am good for a couple days then i freak out agaIN

    I had a Dell account, business related but personally guaranteed. I don't believe mine was secured but I suppose yours may be. I paid on it rather irregularly for about 4-5 months, then filed a few months after my last payment. I never heard a peep from them and they never asked for the merchandise back.

    Not really sure why you can't return the merchandise. At any rate, if you continue to pay on that account to the neglect of your other creditors, they will see this and it can accelerate the timeline for them filing a lawsuit against you. With six weeks before filing, probably not an issue though.

    Lastly, if you pay Dell more than $600 in the three months before you file, you might have a preferential payment issue on your hands. Not a problem for you necessarily but it can complicate the case a bit. I did have one creditor that I paid more than that amount, but I was only slightly over and the trustee didn't want to mess with it.

      TY, I thought all Dell Credit was secured, maybe im mistaken -

      minimum payment is only 60, so it wont be too much paid -

      i also sent an email to my atty, will see what she says as well
