    amount of paperwork needed

    how far back do u have to go as far as paperwork to be able to file for bk?
    i am talking about credit card statements,utility bills,etc etc?and do u need every receipt for all the clothes u bought in the last 3 years?
    3 months,6 months,1 year ,3 years?

    Before I file a client's case, I ask for 6 months of past bank statements for every bank account they have, including PayPal if they sell things online, 6 months of past pay stubs, 2008 & 2009 tax returns, and the most recent statement they have in their possession for all of their credit cards, utilities, etc.
    Of those, after filing their case, I have to provide the trustee the client's 2008/2009 tax returns, past 3 months of bank statements plus the next statement received after the client files bankruptcy, and past 3 months of pay stubs, along with a trustee questionnaire that is used here in the Nevada courts.
    The reason I want to see the past 6 months is so I can see if there is anything that might look suspect and which would have the trustee questioning the client for certain transactions.
    The only times I have had the trustee ask for actual receipts was when clients received $2500-$5000 from their tax refund and then reported that they had only $1k or $2k left in their bank accounts. The trustee wanted to see what they spent it on. In most cases it is my fees, BK filing fees, couple months past due car payment, necessary car payments, dental work for their kids, and one time it was buying a used car since they only had one car.

      well when i retained my attorney he have me a stack of forms to fill out and in there it asks for 3 years worth of credit card statements for all credit cards , and receipts for all the clothes we bought for the last 3 years.
      theres no way i can get 3 year worth of receipts and credit card statements


      is this normal in florida?

        It varies drastically by district & region. I'm in the Eastern district of CA and all I needed were the last 2 years worth of taxes and 8 months of paystubs. My attorney requested the most recent billing statement from each bill, but there were some I couldn't find and they just went off of my credit bureau. I never even needed bank statements--just the printout showing the balance on date of filing....
        Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
        0% payback to unsecured creditors, 56 payments down, 4 to go....
