It's bad enough that they list all of our personal information & all of the creditors we have, but showing my husbands full check stubs??? Does anyone know I can get these removed?
Thanks in advance!
Call the Clerk of the Court. The paystubs (payment advices) and tax returns are supposed to be "restricted". If you filed through an attorney, then your attorney docketed them incorrectly.

Any advice provided is not legal advice, but simply the musings of a fellow bankrupt.

I contacted the Clerk of the Court & was told that check stubs were part of public record as long as they didn't show SSN's!!! I have left a message with our attorney who may not call back until this evening or tomorrow!

Interesting, as my District restricts access to anything in the record as "Pay Advices". So, it's either a local rule or just that it wasn't docketed as "Pay Advices".

Mine show also. They do show 'pay advices' so I think that is a local rule? Our stubs do not show SS# though.
Get mortgage modified: DONE!7 months of back interest payments amortized, payment reduced over $200/mo (In the 'planning' stage, to file ch. 13 if/when we have to.)
Yeah, but when you click the docket entry to pull them up, do you get "Access denied."? That's what I get.
His SSN number shows only the last 4 digits, but EVERYTHING else is viewable......name, employer name, pay rate, etc....
I can click on History/Documents & it opens up in a PDF file showing the last 3 mths of check stubs
Has anyone had any luck in filing a 'motion to seal'???
No, I was able to open them up & print them out. Had given some originals to my atty, will be refiling later this year with a different atty and so I went in to replace my originals.

Wow. I didn't even give that stuff to the BK Clerk. They did not want them. I only sent them to the Trustee and he did not file them with the court and they never went to PACER.
You have to list your employer on the BK petition anyway.
Aside from your SSN; (which should be redacted to the last 4), there isn't anything on the pay stubs that is inherently private or confidential. (sorry to say).
Hopefully there won't be an AP filed, because if it is, it is quite possible (as was in my case) that your financial life (entire filed tax returns, payroll checks, proposed tax returns, retirement account statements, etc.) all become part of the public record redacted only for partial SSN, account numbers and routing numbers. That's real fun!
