chase called to ask me 341 date??

    chase called to ask me 341 date??

    Since filing I have mostly been lonely with no one callling or leaving me any messages.

    Except Chase did call me and knew about the bankruptcy filing, and wanted to know the date for the 341, which I told them.

    First, I thought they were not supposed to call me, but second, are they up to something? Going to show? Just terrorizing me?

    I can't for the life of me think of any way I am vulnerable to a creditor's objection, except I was near maxed out when I stopped paying. Perhaps I should have known that the credit limit they gave me was too high for me? Cant really find any firm thing. So, any guesses what they are up to?

    They can't call you to COLLECT. That doesn't read as though it was a "collection" call.

    I can't tell you if they're going to show up. Is this a secured debt?

      Not a secured debt, just credit card.

      If they were going to show up, why? what could they hope to get out of it?

        A less expensive opportunity to question you under oath. (A Rule 2004 Examination is more expensive to hold.) In any event, speculating what they may or may not do, will probably just cause you grief. At worse, they may think that you "knew" you were filing and ran up the card with eve of bankruptcy purchases. Or... it's nothing.

          maybe they called to scare you, hoping you would offer some money on the phone to get them to not come to your 341. i personally do not think they could have not known the date of the 341 - i think that comes together with the notice of the filing. so i think they were fishing for something. they couldn't ask you directly anything that would sound like they are collecting, but maybe they hoped the conversation would go that way. out of 100 phone calls like that, i bet they end up getting some money out of the scared pro-se debtor.

            I agree. More than likely, this was a last ditch "disguised" collection attempt. It got you worried didn't it?

            Think how most consumers would be reacting to it.

              I don't think it was a collection attempt. That would be a flagrant and punishable violation of the automatic stay. Many Trustees are getting smart about this too, requiring debtors, at the 341 Meeting, to disclose if any creditors contacted them after filing. I have seen omnibus Trustee motions for sanctions on creditors here in Florida. The Trustees are getting smarter.

                ok, then what was it? i don't believe it's possible for them to know about the filing but not the 341 date. there had to be another reason for the call.

                  I have seen the computer screen for several creditors when a person is in bankruptcy. The screen does NOT have the 341 meeting date. The screen only has the chapter, case, District and filing date and discharge date. So, as such, I don't think most creditors "capture" the 341 Meeting date.

                    This is why people should just direct these calls to their attorney.. Sorry Mr. Creditor..my attorney can answer you question would you like his\her phone number? I would then say some else along the lines of .. are trying to collect a debt.. harass them back.

                      yeah i should have messed with them. it was a polite call, though, not like the others from chase. I think once they get bk notice, they forward it to the nice people department, where the water coolers have free vitamin water.

                      i am a little curious, but not worried as all they have on me is some grocery purchases about 6 months out, as far as I can remember. worst thing i figure is i would have to give a few hundred back.

                      Basically the situation was that as I made up my mind what to do about bk and debt, I kept the holding pattern which was pay my minimums at the beginning of the month, use the cc at the end of the month when the money ran out. As soon as I decided to bk and stopped paying, i did not use the cards at the end of the month and instead used the minimum payments i didnt send in. There was a few odd auto debits that i forgot and stopped after they happened but it just chumpchange.

                      I think they are wasting their time, if they are up to anything at all.

                        I have to agree with justbroke about Chase (or its assign) thinking this like a much cheaper 2004 meeting. If I were you, I would get all my facts straight and rehearse answers to possible questions from Chase at the 341 meeting.

                          I wonder if you dont review your old statements, what good is it for them if you cant remember. I had 4 cards that I havent touched in at least six months and cant remember much of anything about any particular cards. So I might just say, I dunno, I dunno, maybe, I cant remember, whatever, you know better than me.

                            Pure brainstorming here:

                            Maybe it was intended to be a collection call, due to your account was accidentally left in the dialing system and not coded properly for BK filed. Then when they came on the line and saw the account notes - realized the BK - and used the 341 question as an excuse for why they were calling? (So it would not look like they screwed up by calling you.)
                            Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
                            (In the 'planning' stage, to file ch. 13 if/when we have to.)

                              They can always, and creditors have been known to, just hang up. Of course, that's just speculation by me. Alas, I have had them hang up and even just say "sorry" then hang up, without saying anything else.

                              Calling you isn't so much a problem as asking for money, threatening acts to collect, or demanding payment. If it only happens once, I tend to just ignore the instance, but record the fact that it happened, in my log.
