I checked PACER, found out my lawyer didn't even list all my debts...trouble?

    I checked PACER, found out my lawyer didn't even list all my debts...trouble?

    I checked PACER and found out that my lawyer did not list all of my debts. He listed the main ones (the credit cards), but not lesser debts I had, which we agree were going to be listed. He has not returned any of my phone calls.

    What does this mean? If the other debts are not listed on the Chapter 7 petition, does this mean they will not be considered for discharge?

    You can have the petition amended to reflect all your debt.
    Contact your attorney. If he asks you for more $$ to file, let him know it was his error and its his responsibility to correct the error.

    This is why we say to check your petition before you sign it, ultimately you are the one responsible for the content of your petition.

        How do you find your petition on Pacer? I went on there yesterday, checked all the menus, and didn't see it...

          You signed it, did you not read it?
          Stopped paying c. cards February 2009
          Retained attorney 11/5/09 - $100k in C.Card debt - $120000 per year income - Filed Feb 2010 - 341 Apr 2010 - No Asset Case/Report of No Dist Apr 2010 - Discharged June 2010
          Case went without a hitch!

            To the best of my recollection, the document I signed included debts that subsequently did not appear on PACER. I'm 99% certain of this.

              Where are you looking on PACER, have you pulled the actual PDF file of your schedules, or are you looking some place else.

                Never mind, I found it! :-) Just had to go poking in the right places. I found it under 'history', and 'documents'.

                  I assume you have a copy of your signed petition. Check it against HHM's (above) advice.

                    There's no option for pulling a PDF file. I entered my case number, then got my case page, then selected "creditors", then some other option. That gave me a full page of information, titled "creditors". It also include the trustee's information, my lawyer's information, and my information.

                        Also, my PACER information lists a certain day next week as the deadline for submitting incomplete information. Does this mean the unlisted debts have to be filed before then?

                        PACER doesn't list any of my other information either, such as income, etc.
