Option to give car back
Filed Chapter 7 in Kansas Feb. 26 and had our 341 meeting April 1. Have not received a reaffirmation agreement from a "lease to own place"where I got a Ford Taurus. Do I have until discharge to give that car back and have it included in the Chapter 7? Thanks in advance for any help. ps My lawyers said just to keep paying if I don't get a reaffirmation offer in mail. Looking at Prestige Finance.

It's in your Chapter 7 right now. What do you want to do-keep the car or surrender it? -

Your lawyer is suggesting a ridethrough.
The lender wants your money-not an old car.
If you do decide to replace the car-just stop paying and tell them to come and get it. If you don't sign a reafirmation agreement, you have no liability for any deficiency balance.Comment

I am thinking of ridingthrough but here is my question. Will the financing bank be able to take the car away whenever they want even if I'm current on my payments? Will they be able change the finance rate on me without my notice? What's the risk of ridingthrough? Is this applies also to mortgages?Comment

that is what I am wondering............am I protected as long as I make my payments? My attorney is not so anxious to talk to me any more since he is paid in full.Comment

Some places will be fine with you making payments, and keeping the car.
But this is not true for all places. See the thread below...
