    Required Debtor Education

    My husband and I have filed for Chapter 7 and taken the first required debtor course. Can someone please tell me when we are supposed to take the second online course? We are scheduled for our 341 in the middle of May (45 days after filing) and I can't remember if we have to have the course done before the 341 or after the meeting. Thank you....
    Obtained an Attorney- 1st week of February 2010
    Filed for Chapter 7 - End of March 2010
    341 Done - Middle of May 2010
    Discharged - July 14, 2010

    The 2nd course is taken as soon after your 341 hearing that you can get it done.

      You can take the post-filing (pre-discharge) course as soon as you want, even days after you file BK. I prefer my clients to have it done before the 341 meeting, but most people do it after the 341 meeting.

        Thank you both for your quick responses. I just want to be sure that we do not miss any deadlines.

          If you complete the course before your 341 and print out your certificate you can hand it over at the meeting. That's what we're going to do to make sure and get it out of the way.

                You can't do that. It has to be filed with the court. Giving it to the Trustee at the 341 won't do that.

                    The requirement to file the certificate of completion of debtor's education course is a local rule and varies by jurisdiction. Here in Nevada we are not allowed to file the actual certificate with Form B23. We file Form B23 listing the certificate number, and we must then either mail a copy of the certificate to the Trustee (if done after the 341 meeting), or we can hand a copy of the certificate to the trustee at the 341 meeting.

                      Just make sure when you go for your post filing education you shop around. I got mine done for I think $15-20. Make sure that they are approved for your state. They should have a listing of what states they are approved in on their site. If not, call and ask.
