    Medical debt incurred after filing

    Can any debts be included in the bankruptcy after the date of file? Do they go off the discharge date or the filing date? I have about $1800 in medical bills that incurred after we filed for Chapter 7 last year (no choice of my own). I cannot afford to pay them. The service was provided after our filing date, but even before our 341 meeting and well before our discharge.

    Can these be included?

    No. The FILING date is the snap shot date of your debt. Any debt incurred post filing is yours to pay.

        unfortunately, you're out of luck. try to work something out with the hospital.

          Why don't you work out payments with them? Is it at a hospital or Dr's office?

            they are suing you already? try to avoid a judgment - talk to them, try to come to some agreement. otherwise they'll end up garnishing your wages and you might as well be paying without the judgment on your record than with.

              No.
              Only those debts listed before the filing date would be discharged.
              Now, if you were so inclined, I guess you could send them a copy of your discharge and hope that maybe they don't know any better.
              You may succeed, but can you live with doing that knowing it's wrong?
              Personally, I would just work out a monthly payment option with them, even if it's only $50 a month.

                wildebeast contact the medical provider and explain that you are just emerging from bankruptcy and can't pay the bill in full and that you are willing to pay as much as you can monthly in the mean time. Even if it's just $20 a month. They may be more than willing to work with you just from hearing the word bankruptcy.

                I went into premature labor after filing and before our 341 back in 2002 and when all of the bills from that began pouring in I called and explained about our bankruptcy and that word alone seemed to scare them into total willingness to work with me. I sent in as much as I could each month and they were happy with that.

                How long has it been since you incurred this debt? If it hasn't been that long then it may that the b word will work in your favor still. Sometimes you'll speak with someone at the medical providers office who doesn't know a whole lot about bk so they won't know that you're still responsible for the debt and work out a payment plan with you that suits your budget.
