All, first I would like to thank each and every one of you for responding to my never ending call for help. Thank you! (This past week was an absolute nightmare with all the bad news my attorney gave to me regarding not being able to file a chapter 7 OR a chapter 13 because of my debt load. Of course he gave me the bad news AFTER I paid in full his fee.) Second, most of you gave me the best advice to seek out another attorney. I did. Truth is the attorney we consulted with yesterday was one of the original attorneys I had on my list to see way back in August. Man do I wish I would have never canceled that consult. Yesterday, he sat down with my husband and I and (we told him everything about our attorney and what he had told us) actually gave us a "plan of action" on how we would be able to file a 7 in May if we followed his plan exactly as he instructed us. He said a 13 was indeed an option. The news we could not file a 13 from our previous lawyer was so far from reality he just couldn't believe it! He said the 7 would be a close fit but a "doable" one if we do what he asked. It was as if the weight of the world was totally lifted from me. Now, I have a lot of work to do in the next month and no, it isn't easy but just knowing it may very well be a reality makes me feel all may not be lost after all! My consult was to only be for a half an hour but he actually talked with us almost an hour and half!!!! His fee is quite reasonable. I paid the other attorney so much of our money and got NOTHING out of it and a measly refund of only $120.00!!! I feel I was scammed so bad. Anyway, thank you to all. Not sure if everything is going to go as we hope it will but at least there is some hope. Happy Easter to all the good people here who have helped me and cared enough to respond. I only hope when this is all over I can be of help to others with my experience. I will still keep posting since I know it's never really over until they close your case.

YAY! I'm so happy for you and so glad that you found an attorney who will fight for you.
Do you mind sharing your "Plan of action?" Of course, I'm just a nosy rosy, and want my curiosity satisfied, but it may also help others who are in a similar situation.Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
0% payback to unsecured creditors, 56 payments down, 4 to go....

That's wonderful Ann! I hope it all works out well for you and your family. Thank goodness you talked with another attorney. (I bet this one didn't use 1/2 your home value either :-)Filed Chapter 13 02/2006 - Confirmed 05/2006 - Discharged 09/2011
I'm not an attorney. My replies are merely suggestions or observations, not legal advice. As always, consult with an attorney before making any decisions.

So glad you were able to find someone to help you!!!! I'm looking hard. Maybe you should post your attorney's name ?????
Ann, I'm in the same sitch as you re untrustworthy attorneys...tho not YET an untrustworthy bankruptcy attorney. Just got through giving a real estate attorney $3500 to do NOTHING but have me jump through hoops getting him information. I did and then sat down for a 3 hour meet during which I learned he hadn't grasped much of anything. Then he called and said : there is an offer coming in on your house and you'd better file bankruptcy right away and BTW, the retainer ($3500) is depleted....for a 3 hour consult at $250 an hour and the sage advice 'file now' .
Happy Easter back at cha!
