    Quick Chapter 7 Question

    Hi all,
    I'm going to be declaring chapter 7. I intended on doing so this month after letting a double payment on my lease car ($620) fall off a credit card (1/3/2010), even though I realize that paying an executory contract is likely not considered a luxury charge.
    Even though I stopped using my cards in January after realizing that there was no way I was going to be able to pay off my bills, I realized I missed a small reoccurring monthly payment ($9.95) and it was approved at the end of February. Could this result in a problem with my creditors? Should I wait until June to file? This is obviously a very dumb concern, but I am so scared of some sort of 523 law suit that I'm freaking out (likely because my filing day is coming up soon -- April 15). Any advice would be helpful.

    Sorry I can't be of any help. We had overdraft protection with our bank(BOA) and we didn't notice but they were deducting their payment out of our checking acct. It was small amounts...I guess that's why we didn't notice. Well, they closed out our overdraft protection but continue to take their $20 something dollar payment each month. Would this be considered preferential payment ? We are planning on closing the account as soon as our credit union approves us for a checking account.

    Can anyone answer mine and plisar's question ?

      Are they preferential payments. Likely. Will they mean Jack. I hardly think so. $10 or twenty bucks here or there isn't worth anyone's trouble to try and get it back.

            I've beat this question down as well and was told 12 months look back for insider (family members, friends) and 90 day lookback of 600.00 or more is considered the amount a trustee will then move to take those funds back to issue to all creditors.
            Retained lawyer: 3/30/10
            Filed Ch. 7: 4/07/10
            341 Meeting: 5/19/10
            Discharged: 7/26/10
