We're holding off on the Chapter 7 a little longer and I wanted to know if there is a website or if there is anyway of finding out if one of the CC companies is suing us. I know there are suppose to notify you. At least I think they are. Is this correct ?

How do you check if you've been sued ?

You will be notified and you will have plenty of time to get you bk rolling. Collectors have to go thur lots of paper work to sue, most of the time you will find they wont even bother. Cost money, paperwork, court dates, blah blah blah. My girl friend hasnt paid her cc in over a year... The next step they are taking with her is writing it off as bad debit.

We don't really have high high balances. We have 1 card with 20,000 (okay that one is High) but the other ones, we have 4 or 5 other ones with a balance of maybe $2000 COMBINED. $200 on one card , $600 on another one.., etc. It would be stupid for them to sue us to get back $600 bucks. Written off does not mean forgiven. I'd chalk it up to internal accounting purposes for the creditor. They must account for what is owed to them, and once an account has gone delinquent the odds of payment decrease. They must adjust their accounts receivable figures and bad debt figures accordingly.
If a creditor files a lawsuit, you must be served. Normally at your home address - and it will have a deadline for filing an answer. You will probably received snail mail advertisements from bankruptcy attys & debt negotiation/settlement companies in large quantities once its filed but even before you've been served.Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)
