    Yikes i need help once again!!!

    Ok so I don't have a lawyer and I need help. I have recently returned a car to a buy here pay here location due to the inability to keep up with the payments. The last time I talked to the lady she said that they were just going to resell the car. Yesterday she calls me and tells me my balance is 2088.00 and they are sending it to auction and I will be responsible for the remainder. I did not add this to my creditor matrix or schedule F due to what she had said to me before...My question, How do I file an ammendment so that I can add this debt to my matrix as well as my schedule F???

    Contact your bankruptcy court clerk. He/she can't give legal advice - but is the source for procedural advice. Say you need to add a creditor, ask what form & the process.

    While you're at it, if you have ANY debts not listed for any reason - this would be a good time to resolve them. You should/must include anyone you owe money to.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)

      I called this morning and said that there would be no fee for me to add them, but I needed to add them to my creditor matrix and my Schedule F but when I asked how to do it, and gave some examples she said that she couldn't tell me how or where to put the information =(

        More than likely, you can revise your existing matrix/schedules - mark them (top/center) as amended or revised - and resubmit them.

          Bear in mind -- maybe ask the clerk -- that it might be your job to make sure that the new creditor is properly served, too. (That's a procedural issue.) The court will usually do that for your initial filing, but not necessarily for amendments, and there's the question of how to serve them -- ranging from just mailing something to them, to having a third party send certified mail and then you filing a signed proof of service with the court. I don't know if that varies by district or not, fortunately I never had to serve anyone myself, I just raise the issue so that you can make sure you're doing this correctly.

          Have you looked through your district's local rules? Those might sometimes have requirements about how to amend schedules. It does vary a bit.
