    Means test Schedule I & J

    If you fall under the median income for the means test, does the schedule I & J come into play?

    If you are under the median income, is it possible to still not qualify for a chapter 7 filing?

    Schedule I & J are always completed - 7 & 13, over or under median.

    And yes, if you are under median but have disposable income then you may not be eligible for 7.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)

      Does the house payment get counted even though I don't plan to keep it? I will have to stay somewhere. Right?

      I am current on my 1st, but have not paid on my 2nd for months now. Would I include my 2nd payment also?

        For a Chapter 7, Schedule I & J are probably more important than the Means Test (Form B22A). The reason is, that the Means Test is just a "test" to determine your initial qualification. Schedule I & J are where the rubber meets the road.

        Yes. If your Schedule J shows positive disposable income greater than $182.50 or... between $109.58 and $182.50 without overcoming the "presumption" or having "special circumstances"... then you do not qualify for a discharge under Chapter 7.

        In some Districts, if you are planning to "surrender" the home, you can't use that expense on Schedule J! You get to use, however, the IRS Standard for housing.
