We contacted our attorney back in October 2009 right before we stopped paying our cc's and mortgage. Since then we have spoken to him twice. All the other times we deal with his law clerk. She is a young girl who is very nice but often answers our questions with "I think". Our lawyer does not return phone calls or emails and whatever we have learned of Chapter 7 has been either thru this site or other research we have done on our own.
I would like to get a new attorney. How do I go about firing this one ? We haven't paid him a cent. He is provided to us thru my husband's employer. So we do pay a small monthly charge that comes out of his pay. But not much.... maybe $12.00 a month.
He did fill out (or I should say his law clerk) the petition for us. It has not been filed. We did give him a check for the filing fee but he has not cashed it.
Do I even have to contact him ? I feel like we don't even exist. At our first meeting we went to see him to talk about our lenders refusal to offer us a loan modification (even though we qualified) and he basically steered us towards the Chapter 7.
Thru the legal plan from the employer we are allowed to use another attorney. I just want to know how to go about properly firing this one.
