About my issue...Husband and I filed for Chapter 13 pro-se in California on 2/19/10 and requested and received an extension to file schedules, statements and plan. After consulting with BK lawyer, we were told that we don't qualify for 13 because amount of secured debt is too high. Finally decided that we would file chapter 7, because we don't have the means to pay attorney to help us with filing chapter 11.
My questions are:
- Should we dismiss the chapter 13 filing before filing chapter 7 or can we "convert". If converting to chapter 7 is possible, where can I find a sample of an "Ex-parte motion to convert chapter 13 to chapter 7 bankruptcy"?
- If a chapter 7 is filed, either through new filing or conversion, how soon do we have to produce the schedule and statements?
Would be very grateful for any answers to my post.
