    Tax refund filing chapter 7 will this be a problem

    We are filing Chapter 7 and have a question about our tax refund. We received $6000.00 We had to pay a family member back $500 that we used when our daughter was ill back in October. Our daughter was sick for 5 months straight and ended up having surgery in December. So we paid off all of those bills plus dental bills. Bought ourselves and our 3 kids clothing, and shoes. Nothing special very minimal. Had eyes exams and glasses for 2 of our kids and then some minor vehicle repairs and built our pantry back up. I never thought this would be a problem but now reading others posts I'm getting really worried. I have all hospital and dr. bills but did not keep clothing and food reciepts.Oh and our attorney fees also. Is this going to be a problem? There is no way we can pay back $6000.00. I read somewhere that they give you 10 months to pay back. We will be breaking even at the end of each month after filing BK. Any advice is appreciated.

    The only thing you may have to worry about is the $500 you paid to a family member. On your other purchases did you make them with cash or did you use your debit card ?? Debit card payments would show up on your bank statements.

      Thanks for your reply. The only ones that came out on debit card would have been dentist, hospital and doctor bills. The rest we took out of the bank and paid cash as we went along. We got our return First of Feb. What will they say about having to pay back a family member the $500

        If they bring it up they may give you the option of paying it to the TT, otherwise they will go after the family member. In your case without paper receipts or debit card transactions the TT may grill you as they will see you withdrew large amounts of cash and will want to know where it went. Just inform your lawyer and follow his advice, chances are the only thing to worry about would be the payment to a family member.

              From what I've read here, insider payments have a 2 yr look back and amounts have to be over 600.00. Unless I read incorrectly, you should be fine. I am waiting to file in april so a cc payment I made goes under 600 iwithin 90 days so a trustee can't say insider payments on it. I plan to reaffirm the debt since it's a joint aacct while I'm filing individually.
