    rental income after discharge

    My case was discharged last week and I included a rental property in the filing. The mortgage has been discharged and I indicated I planned to surrender the house. The tenant is still paying rent and will until the lease ends in 3 months. The bank indicated that it may take 6 months to foreclose now the stay has been lifted. I am unclear what to do about the incoming rent. Any guidance would be much appreciated.

    it feels strange indeed, but i think as long as the house is in your name you can take the rent. who else would the rent go to?? the bank? no way!

      Until the rental property is foreclosed, it is your property and you have a full responsibility on it. That's why management companies collect rent from tenant until foreclosure (no matter what the status of the mortgage is).

      The rental contract exceeds mortgage issue (current/late).
