    Lien Strip in Ch. 7?

    I understand that Lien Stripping is not allowed in a chapter 7 bk. Most of my findings are old, are there any new laws that have passed recently that allow this?

    No, but many people with "unsecured" second mortgages attempt to settle after the discharge of a chapter 7.

    If you want to guarantee that the 2nd lien is stripped, you'll need to file a chapter 13.
    Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
    0% payback to unsecured creditors, 56 payments down, 4 to go....

      I'm just days away from my ch. 7 discharge....I hope. I'm just trying to find a way to possibly stay in my house. I'm not going to keep it considering it's worth $40k less than I owe now. If I can get the mortgage down to what its worth then I'll consider keeping it. Is there any way to do this? I have a 1st and 2nd mortgage on it. The second mortgage is about $18k.
