    There is a slot on the means test for disability insurance. Do you have AFLAC? You could add that, you can buy it directly from Aflac if your employer doesn't offer it.
    Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
    0% payback to unsecured creditors, 56 payments down, 4 to go....

      Hi Ann,

      I am also in the exact same potion as you with overtime. I am over the median; however pass the means test when my "real" expenses are added. Using the IRS expenses is very borderline so I am racking my head for unaccounted for expenses to add to the means test and cutting out ALL overtime for the next 6 months to qualify for a 7. It will still be close and I am more stressed now than when I finally decided I needed to file.

      I live for overtime and this will be the final financial blow to my family. I cant pay bills without overtime so here we go over the financial meltdown falls.

      I also will not accept a chapter 13. I do not want a trustee in my life for the next 5 years. If I cant get a chapter 7 then I will walk away from my house payoff the bills as best I can and take what comes.

        Screentest, are you purposely forgoing all overtime? In our case that is not an option. What I do wonder is, when asked if you anticipate an increase or decrease by 10% of your income can you say you estimate your income to drop because of overtime not being anticipated? Am I way off here?

          My overtime is not guaranteed, it is random. It averages out each year however; there are long dry spells of months at a time with none available followed by a spat of unlimited overtime for a period. It is this period that I take all I can get literally working 120 hours a week.

          Overtime is voluntary unless ordered to work so I have the option to pass on this overtime and actually see my wife and kids more than 3 days a month.

          Yes I can anticipate a 10% drop in income without overtime and the threat of a real 9% paycut coming this July because of our state budget mess.

          It is this forward factoring that is making my BK decision soon to be inevitablel. I cant keep this cycle up, (hoping for overtime) just to make ends meet and lose my health and family in the process.

            Yes, if he didn't HAVE to work it he wouldn't!!! This is company policy that you CANNOT refuse overtime if the company requires you to do so!
