    Professionalism..

    Have any of your Attorney's called you prior to or after your discharge?

    I called mine, "I call you by the end of the business day" "I'm at lunch I'll call you later". It's been a week now and haven't received NADA?! Talk about professionalism?!

    Still pissed he didn't petition to reaffirm my car!

    1. You don't need to reaffirm the car and unless it is absolutely required, it is NOT in your best interests to do so

    2. What is the purpose of the call, generally NOTHING happens between the trustee meeting and discharge, so there is nothing important to talk about.

      Ok I see...

      I lost the car because he didn't petition to reaffirm it, honda moved for relief of stay because they said they didn't hear from him so they repoed it.

        Providing that you made it clear to Atty that you wished to reaffirm, then it sounds like Atty screwed up here. Often times creditors will inititate the agreement but then if the acct history has been a problem acct, I can see why they wouldn't take the first step here.

          Yes I made it clear to him.
          When I first got notice that they were moving on relief he said he was working on it. Then 2wks later I see relief granted?!

          I know it's to late to turn back, the should haves, would if's!
          Time to move on, get my report updated and try to get another car.

          Just pissed I lost my car with only a yr left!

            Were you behind on payments?

            I didn't confirm with Honda and my lawyer didn't contact them.

            I just finished paying the year out and they sent me the title.

              I was first in a 13 for 6 months than later converted to 7 so all those months in 13 made me be behind in payments.

                I think the lender is lying to you, they probably didn't contact your attorney. I doubt they were interested in reaffirming, after all, if you only had year left, the bank was probably going to break even or barely lose any money on the repo.

                However, why would you be 6 months behind in a chapter 13, were you trying a cram down. Normally, you keep making your car payments in a chapter 13.

                  I'm sure your attorney explained that to you. If not, then he should have. Being in a Chapter 13 could reset the payments and make you "behind" in payments -- automatically -- when you convert to a Chapter 7. (Been there, done that.)

                  There is definitely a communication problem between the two of you. The car lender probably never contacted your attorney anyhow. In most cases, it is NOT in the best interest to reaffirm the debt anyhow. This is why I am redeeming my cars rather than reaffirming them. Reaffirming it when it's still upside down is a very bad thing to do.

                  I don't know where you go from here. Maybe this works in your favor. We have a debtor on this forum who reaffirmed a car, only to not be able to pay for it. It was repossessed and then they were given a vary large ($10K+) deficiency bill, that they are responsible for!

                    Yes, Exactly communication was a big problem!

                    I knew about cramming down the payments but all that was reversed with the conversion to 7. Which now I see Honda loved!!

                    So much for the "they don't want your car only the money".

                    I know who ever gets it they have about 2k in maintenance to take care of that I was about to do before they snatched it.
