My wife and I are planning on filing Ch7 as late as possible but.... I received a letter from my first mortgage saying that they had sent the account to an attorney to "initiate foreclosure".
I'm in NC which is non-judicial power of sale. According to what I've read, the trustee has to file a "special proceeding" in my county which supposedly takes about 60 days.
There is also a "notice of hearing" which requires 10 days and a notice of sale which requires 20 days notice.
My questions are:
Will I receive a notice when the special proceeding has been filed?
Can the notice of hearing be filed within that 60 day period as well?
Do things run consecutively or concurrent?
Will attempting to modify the loan delay the process?
