    Can a small claims court judgement be discharged in a chapter 7 bankruptcy?

    I have met with my lawyer and will begin preparing to file chapter 7 next week. I will be including back rent in the BK. My landlord has threatened to sue me and worry that he will take me to small claims court before I have filed the BK and get a case number.

    As long as it is for a dischargable debt - yes it can be discharged. Debt owed to a landlord would qualify. Debt owed as a result of drunk driving property damage, for example, would not.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)
