    On the inbetweens (filing-341, 341-discharge)

    I have been searching, reading, etc. for the past several weeks. We hired an attorney a few weeks ago, just waiting for the petition to arrive, review and file.

    I have a few questions about the process...

    After we officially file can my husband start working overtime? In other words will we be finished watching how much we spend and make?

    What happens between filing and the 341? Anything we need to be cautious about?

    What about between the 341 and discharge?

    If you were close to being over the median or failing the means test, I would consider waiting until after the 341. The trustee usually asks if your financial circumstances have changed. He might not care at all about overtime, but I'd still try to wait. It shouldn't be a problem after the 341. Unless you have unusual circumstances, all you do after the 341 is wait out the 60 days. You will have no more contact with the trustee (I'm assuming you are a "no asset" case).
