    Phone calls

How soon after filing will the phone calls stop?

    #2
Mine stopped immediately surprisingly enough. Most was likely coincidental as I was playing games with the creditors prior to filing.

Not knowing exactly how long it takes for the creditors to be notified to you filing I would call each one and let them know yourself. Be polite give them the lawyers name, number and case number and don't answer any of their questions.
    Chapter 7 filed December 11, 2009, 341 Meeting held on January 7, 2010
Deadline to File a Complaint: March 8, 2010

Discharged and Closed March 11, 2010

Start answering the phone when you have a case number and give it to them. They will stop within a few days.

Within a few days, a week at most. It goes quicker if you can supply original creditor AND collection agency addresses to your attorney. Otherwise it can take a few days for OC to get the notice and pull it from the CA. Some receive electronic notice from the BK court, which means they know almost instantly.

Once you have filed - start answering the phone again. For anyone calling about a debt, write down what company they are calling for & give them the case # and chapter filed. They may want the atty name & # also.
Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
(In the 'planning' stage, to file ch. 13 if/when we have to.)

Mine stopped immediately when I started answering the phone. I informed them I filed bankruptcy and if they had questions they could speak to my attorney. They would start asking all kinds of questions such as what chapter, case # ect. My reply was:

My attorney can answer that question would like his phone number?

Same here. The moment I had the case number after filing I answered every call. I would let them finish explaining I was late, the amount I owed and that they could take a payment over the phone. I politely asked them to notate my account with a bankruptcy case number. All of them asked for my attorney's info and some asked for the case number and chapter. Once I provided each creditor with this info, the calls stopped. It took 2 days to field all my creditor calls and provide the info. No calls since.

                  4/21/2010 - 341 Scheduled

Wow, it went down from 20 calls a day (!) to none after about 4 days. I did pick the phone a few times after filing to give out the news, but a bunch that I had not talked to stopped calling as well. I'm somewhat missing the attention.

I'm wondering, does the BK attorney usually call everyone, or do all creditors get a list of SSN's that have filed every week (or day?) and hence take the debtors off the list?
