    Spouse's money deposited into joint acct AFTER filing?

    Will it be a problem if my husband's tax refund is direct-deposited into our joint banking account? I filed chapter 7 individually in February and just had my 341. Trustee wants to see my tax return before mid-April, and my attorney told me to file taxes separately this year so that any refund my husband is entitled to isn't held up in the BK.

    In addition, she mentioned that we might want to have him open his own bank account and have it sent there instead of having it deposited into our joint account. Anyone know why this would matter? I thought his assets, especially after my filing, were off limits and couldn't be touched. Is she just trying to be extra careful?

    My advice would be to ask your attorney this same question. Since you are filing BK separately from your husband and your case has been evaluated in that vein, it is probably vitally important that you keep each of your assets separate, as well. Separate bank accounts are a part of this. It's cleaner, and having funds deposited into your account, even though it is technically your husband's revenue, might raise a flag. The fewer flags, the better.

    I'm stabbing in the dark, though. Ask your attorney what the trustee will be examining affter the filing date.
