    Finally!! He filed!!!

    The attorney finally filed today and our 341 is set for 04/22.

    Is there anyway to find out information about the trustee and judge? I searched the forums for the names, but didn't get any hits for reviews/experience. Maybe there is somewhere online that I didn't find when I googled?

    I imagine you could look up cases in Pacer - but @ $2.40 a file it can add up if you're not careful!!

    Congrats on moving on to the next step in your financial well being.
    Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
    (In the 'planning' stage, to file ch. 13 if/when we have to.)

      I have a question for you. I see that you stopped paying on credit cards over a year before filing. My attorney (well he will be) once I come up with the money for him advised me to do this also. I'm about to be my first month late on all but one that is 2 months late now. I can't afford to come up with the retainer fee until probably May. I'm worried about my creditors filing lawsuits before then. I have about 20k in total debt. The biggest balance on a single debt is 7k. Did you receive and summons for a pending lawsuit before retaining your attorney? I know I will be flushed with calls soon but I can handle that. I'm just concerned about creditors filing a lawsuit before I can retain the attorney and get things moving.

        I'm sorry I can't help you with your question - I made a mistake in my siggy.. we stopped paying in 01/2010 I know there are lots of people who can help you with your question though! I know I've read some posts where people ask similar questions and from what I've read, some people have gone years without paying cc's and without receiving any lawsuits and then some people have been sued only after missing 2-3 payments.

          Creditors are very unlikely to take action (other than calls, letters) for at least 3 months of late payments. Most would go to an external collection agency somewhere around 4-9 months.

            ps-We stopped paying 4-5 months before filing. More on some cards, depending on payment amount required.

              you might get away with 6 months, just have to deal with the phone ringing nonstop.

                I can deal with the phone I just won't answer it. I should be fine in May to afford the attorney maybe sooner. I just didn't want to receive any summons in mail before I got the ball rolling. I'm so glad I found this site tho. I have been struggling for years. I tried calling my debtors to get a lower rate they say no. So for years some of the debt is more than 6 years old. I paid minimum and that has got me nowhere. I'm late by one day they all take on their fee anywhere from 30-50 dollars so that kills me the next month. All I think about is this. I wake up in middle of night every night to my heart pounding. I'm turning 38 this month and if I stay in this position of struggling and trying to keep paying minimum and getting nowhere I'll be dead by 40. I just want to have a life again not just an existence of work and paying bills and getting nowhere. I've been doing that for so many years that it's really starting to kill me.

                  I went a whole year before I could file (see my signature) and wasn't sued, but there is another poster here (today) that was sued after 5 months! If you've stopped paying the creditors then that extra money should be saved for attorney fees.

                    We stopped CC payments last Aug, so we are at 7 months now. We plan on filing late this month or early April.

                          back to the original question, you won't really find any reviews of trustees. there is nobody out there who would write them! attorneys wouldn't because they need to be on the trustee's good side. and debtors wouldn't for the same reason. so the right to free speech is out there, just doesn't get exercised in many cases... but yes, you could look up in pacer. you won't find anything useful there though. if you want to know what your trustee looks like and how he/she behaves, you can call the court or the trustee's secretary and try to find a 341 date before yours and attend it.

                            Thank you That's kind of what I thought would be the case. I think we'll definitely try to sit in on some cases to see how the trustee & judge are before our meeting!

                              there is no judge at the 341 meeting, only trustee. i never saw a judge in my bk case, and most people don't. so don't worry about the judge!
