    maintaining seperate households

    Anyone on here who has filed chapter 7 while still married but filed seperately?I don't mean just filing alone but stating on the forms that you are maintaining seperate households and not providing any of spouses information. Any problems from trustee or additional documentation needed?

    Well, so long as you can provide proof of separate households and have a explanation for the purpose of doing so; also, so long as the spouse contributes NOTHING to your household expenses in any way; then yes, you can do that. But be prepared for additional documentation 6-12 months bank statements (you do maintain separate bank accounts, correct?)

      We have seperate bank accounts. We have also filed our tax returns seperate for 2008 and 2009. We don't live together but my spouse does give me money monthly for the childrens support as I have custody. We don't have any formal seperation agreement.

        No problem, however, you will need to declare that support money as income, but you will not need to involve your spouse in any way in your BK.

            Does one need to have a legal separation filed with ones state of residence to file chapter 7 married filing singly with declaration of separate households.
