    Discharged, Citifinancial stills wants me to pay

    Hi

    I got my discharge on the 3/8 and my case was closed the same day.

    I had a personal unsecured loan w/CitiFinancial who is telling me that unless I pay the balance they do not reflect a balance of $0 on the credit report.

    Does anyone know about this?

    The people in the BK department don't seem to understand that this is a law.

    I would call my lawyer and keep everything Citifinancial sends you, they could be sued....

      Oh MAN I wish one of my creditors would get stupid with me like that!

      I assume you filed pro se. Was CitiFinancial on your list of creditors? If so you may be able to sue them to the tune of 1000.

      We had issues with CitiFinancial before we filed, we paid off the balance ($200 for a dryer) months before we filed but they said we owed $2 and some change. Out of principal we told them to pound sand, we weren't paying it. They added on fees and intrest making the balance owed over $300 in just 2-3 mo! We included them on our BK and they promptly sent us a revised statement showing balance was paid. They are some shady SOB's.

        Save everything they send you. Record every phone conversation (if one party recording is allowed in your state). Then (after they've sufficiently hung themselves) sit down with your attorney and spank them.

          Yeah, I know for sure they were included because they told me they see the discharge. They say this means nothing because according to them they don't have to report my balance as $0. This was a personalunsecured loan.I don't understand what they are doing.

              Sometimes the bank rep can't see their computer screen with their head so far up their (!), and that tends to cause them to say STUPID things like this.

                We had a personal unsecured loan with Citifinancial too that we IIB... our credit reports show IIB $0 balance and we have never once heard a peep from them since the day we filed our BK.

                  seriously! my guess is their bk department will eventually take over and report it correctly. give it a couple of months. if they still go after you then, go sue them. and if they call, tell them you are recording the conversation so it's legal in all states.

                    Wait a couple of months? Not in todays automated world. Citi knows that this debt was discharged in bankruptcy. The OP said that while on the phone to the rep that the rep saw the notation on the file.

                    I'd be documenting, recording and saving smoke signals for only as long as I could take it, then I'd be picking up the phone and calling my attorney. There is no excuse for what the OP was told. If Citi needs to retrain their customer service reps that is their problem. It shouldn't be the OPs problem.

                      What they are doing is attempting to intimidate you. Are you going to take this? Get evidence and after your Judgment award, enjoy a night out on them or even a vacation as they are a big outfit and know better. Find a shark who will work on contingency. You have a potential gold mind if you play it right. 'Hub

                        i just think most attorneys wouldn't sue them before giving them a number of opportunities to fix it. i think the attorneys should sue much more. i just don't think they do.

                          Did you file pro se? At this point you need to point out to them by certified mail copied to Citifinancial's general counsel that unless they stop violating the federal court's permanent injunction that you will be filing a motion to show cause why they should not be sanctioned by the court. If you have an attorney, he/she should be all over this because then they will get their fees paid by Citifinancial to file the motion. This isn't even a gray area, it is a slam dunk.

                            I have an attorney which is less then helpful. Left her a message and sent her an email a few days ago, no response, maybe because my case is closed. I usually have to show up at the office. I will definately be writing everyone I can to make them aware of what Citi is doing.

                              Cinderella, do a search in your state for a consumer protection attorney. Many of them are well versed with this type of thing and will take on your case happily. Most will also help you at no cost to you, they are awarded their fees at settlement time. Please save and document everything.
