Can Trustee request bank statements from bank directly

    Filed BK7 on 1/16/10:
    341 on 3/16/10 (No Asset)
    Discharged 5/17/10 (Fresh Start)

Not without a subpoena. Generally, the Trustee would rather just ask you for the necessary documentation. The Trustee may ask for that information at the 341 Meeting, it just depends how your specific Trustee likes to work.
    Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
Status: (Auto) Discharged and Closed! 5/10

Thanks Justbroke for your response. I kind of figured that was the case, but just wanted to ask for clarification.

yeah, the trustee can't go behind your back. and, you are required to provide the trustee with any infromation requested, so the trustee doesn't need to go behind your back. if htey didn't ask for it, they don't need it.

Music12, that is music to my ears. So far the trustee has not asked for it, and I contacted my attorney to make sure that I did not need to bring any statments with me to my 341, and my attorney said the trustee does not need it....

The responsibility of the debtor is to prove that he or she is bankrupt. That might include showing your bank statements to the trustee to prove you're not hiding assets. When people are unemployed or self-employed this is common for the trustee to ask to see these. It's best to comply with the court if you want to get a discharge in your bankruptcy.
