    Statement of Intentions

    Does anyone have any advice with regards to secured debt and filling out the Statement of Intentions and the Reaffirmation Agreements?

    I have the following: 1st mortgage, 2nd mortgage, car lease, timeshare. (secured debts)

    #1 doesn't want a reaffirmation agreement
    #2 won't take my calls.
    #3 won't agree to an "assumption agreement" for the lease
    #4 we can't afford and want to surrender

    As I see it, I can't submit a reaffirmation agreement on any of these secured debts. So do I just file the Statement of Intentions , serve the 4 plus the trustee, and be done?

    Reaffirmations almost never benefit the petitioner. I'd do ride-throughs.
    Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

      I agree more than 100%. We reaffirmed only due to the fact that I was 45 year member of my CU and wanted online payment on my car that only had 3 or 4 payments left. Also I had 2500 OD credit that I paid up and still have with them. Otherwise it is foolish to defeat your goal of a new start by encumbering yourself with the same debt that brought you here. 'Hub

        Like the others said, reaffirming doesn't really benefit you. Okay so you get to have them report to the credit agency in a positive light, but is the risk really worth it?

        That makes sense Hub, to reaffirm with only a few payments left. I had not thought of that scenario.

          I would avoid reaffirmation at all cost. Just ride through on them.
          4/09 Converted to a Ch 7 due to loss in dh's income
          5/09 UST now involved no idea what happens next
          7/09 UST has decided to withdraw his motion to dismiss!
          7/27/09 DISCHARGED!!!
