    Nervous

    Had 3rd meeting @ lawyer's today (with his secretary). Signed a bunch of filing paperwork and she has to re-run the Means Test w/February payroll figures now that we are into March (THOUGHT we were going to be able to file in February but it didn't work out that way for whatever reason).

    I am just nervous a.) that something will come up and we won't qualify for Ch. 7 (unlikely but we were VERY close w/the Means Test when it was first ran in January). b.) that they will drag their feet and we won't get filed until after March 15th. I read somewhere that after March 15th, the median income guidelines for BK in Ohio will DECREASE and thus, we will be screwed!

    I DID forgot to ask about the median income decrease. Does anyone know if it is in fact true?

    I have to spend down our checking account so I paid a mortgage payment today online. I can't call lawyer with the figures until it clears and the lawyer hasn't cashed the significant check I wrote them either

    I guess they will file everything electronically so I hope we will be 'in' before the 15th!!

    Stop worrying. The income guidelines change on April 1, 2010. If you signed the paperwork and it's only the means test being re-run, why are you worried? Attorneys are required to file electronically in almost every single District.

    By the way, the median income guidelines have nothing to do with being able to file a Chapter 7. It's your income less expenses, that qualifies you for a Chapter 7 discharge. This is known as your disposable income. The median income guidelines have absolutely nothing to do with your income less expenses. That median-income (over/under) guidelines is just whether you need to do the means test or not.

      I am a natural worrier that is all. I'm a Virgo. Can't help it...it's in my astrologic genetics

      I did think a little bit more about the income thing and remembered that our income after expenses leaves us less than 100.00/month in disposable income. Whether they change the income guidelines or not will have no effect on this fact! Guess I panicked a bit and was confused to boot!

        I think you'll be fine. Your attorney didn't mention anything and you're at $100 in disposable income. I wouldn't worry. Being under the median does make it a little easier to sail through, but I wouldn't let that bother you in any way since you'd probably still be really close.
