    UST got involved

    When I filed last January, UST was involved requesting an explanation on my pay stub not matching with the schedule. Basically, I have a back pay in April that shows in my pay stub when I filed. My lawyer has to explain in the schedule and also not included in 6 mos look back. Now UST was asking below:

    1. Current pay advices for employment and documents which reflect current VA pension benefits from January 1, 2010 to March 2, 2010;

    2. most recent mortgage statements for the first and second mortgages

    3. current payment statements for the loan on the 2000 car payment

    4. detail the circumstances which led the debtor to receive $12,724.67 in back pay and when this payment occurred.

    I am over the California median of six family with 103 K total gross, am I being scrutinize by UST because of this or is he trying to convert for BK13? Even the back pay was included in the means I still pass. By the way, 341 was rescheduled due to Trustee did not receive my tax return last year and he do not want to see what the lawyer has because his policy is requirement should be in his office seven days prior to the meeting but return was submitted when my BK7 was filed. Thanks in advanced.

    Sounds like the UST is just trying to figure out/match up your statements. Once everything is settled and they see there is no extra $$, you should be fine. How come your attorney didn't tell you to wait until this extra income fell off the radar? Did you end up using J.B. in Riverside for an attorney?

      Looks like UST was just trying to verify the amounts. The back pay was in May 09 and the money went to dental, tuition fees and two major car repair. I filed in Jan 10 so 6 mos look back does not cover them plus I have summons from AMEX and NFCU so I filed right away. I went with a friend paralegal/lawyer in LA. Thanks Liz.
