    What day to file?

    Is there a certain day that the filing gets done? Is it the end of the month, beginning, Friday? Does it matter? OR do you choose?

    I've got an email in to my attorney asking about this very thing. We can only file during a very specific window in March. It has to be after the 12th but before the 19th. The reason why is because of the dates our bills fall due. Filing during the period between the 12th and the 19th would be best for us because that's when our checking is at it's lowest. Otherwise the funds for our car payments and mortgage would be in danger of being taken by the trustee. I'm waiting to hear back and see if our petition will be ready to go by that time frame. If it's not then we can't file until that same time of the month in April.

          So if we choose the 20th for instance. What would be the last pay stub they would look at? After the 20th would it be safe to work overtime?

            They will definitely want to see recent pay advices up to when you filed. However, trustees sometimes do ask for pay advices that post-date your filing. I'd expect you to be safe after a "successful" 341, but you certainly can't be sure beforehand, because they can look for if the totality of your circumstances has changed, because they worry that people might time their filing to be right before a pay raise. To keep them off my back, before the 341 I submitted the next pay stub from after I filed that closely matched what I had declared on Schedule I.

                My attorney says that I fill out the paperwork, they review it with me and finalize it, it's put into the computer, and on whatever day *I choose* they file it.

                He said to plan on approx 4 weeks to fill it out, go over it, revise it, etc.
