    Means Test making no sense!!!

    Hey guys looking for a little help on the means test....I have read now in a number of places online that if your income is less then the median income in your area thats it, you pass period. Va median $48K I made $34K last year. For the last 5 months I have stayed with a realative and have had not much rent/mortgage and I have concerns about the rest of my income being disposable income?? Any help on this we be greatly appreciated.

    First, the means test is really but one hurdle. As you eluded to, your actual income, less expenses, yields your disposable income, and this is looked at as well. Since you are not living anywhere, you can technically claim the "IRS" allowance for housing. However, this may or may not pass in your particular District. Most Trustees would agree that you would have a rental expense in the future, so should allow the rental expense.

    Of course, your attorney would know more about the practices in your area.

      Also my lawyer and I talked about moving out of my relatives house (which I have to anyway) and getting an apartment....problem is with my credit they wont rent me an apartement....I've tried!!! They approved a co-signed but I'm only listed as an occupant will this be fine as far as legit rent and an expense??

        Look for apartments from actual owners. Maybe in historical/trendy areas. They tend to be old but cheap (swanky too!).

          Yeah, I've had little trouble renting from private owners with terrible consumer credit but good references.
