    Cell Phones after discharge?

    My wife and I were discharged in December 2009. We did not include our cell phone contract (we were not behind on payments) for discharge. We did not reconfirm our cell phone contracts, but I don't know if that matters or not...

    Is there any way to get out of our contract (with Sprint)? I know it sounds silly, but their service has been awful since we got them (about a year into a two year contract) and we'd prefer to move on to a different carrier-if possible.

      Since your BK discharged in December, and you've had usage for January and February, I would think that would be deemed new debt.

      Someone else who has done this though may have something different to add..

        I filed with cell phones with a contract. The monthly charges were included in my Schedule J and there was no issue with the trustee at the 341. The "new debt" of payments since are no different then the "new debt" of a new electric bill or insurance bill.

        Can you get out of your current contract? Yes. You did not need to include it in you BK because there is no debt. To cancel you would fall into the same requirements as everyone else that cancels a cell phone contract early. You pay. Period, that's it. There should be no effect on the BK just as having a monthly cell payment had no effect.
