    Schedule B: List Non-Filing Spouse's Property?

    Filing in NY, so a 'common law' state and not a 'community property state,' but I am not really clear on this one, though I suspect that we don't have to itemize the non-filing spouse's personal property on Schedule B, correct?

    Non-filing spouse has two cars: 1 she is making payments on, which is listed on Schedule J for auto, and 1 she owns outright.

    Given two cars, we used a monthly transportation/maintenance figure that is close (but still under) to the national average for a family with 2 cars.

    Without the cars being shown on Schedule B, I am just not sure if this raises a flag, since once one car is reflected in the auto expense on Schedule J.

    ...could see the Trustee asking about the transportation expense and being higher than it should, given he really will only knows about one of the cars.

    ...and here is a blank Schedule B, should anyone be in need of a continuation sheet and not want to use a blank sheet of paper; while I got bored and decided not to style it with alternating fills, it will suffice and looks more professional that a blank 8x11.

      I believe you must list ALL of your personal property on Schedule B and you list what is exempt on Schedule C.

        I read NOLO again and not quite sure...since in NY, only the property the debtor owns plus 1/2 of the property they own jointly is considered "part of the bankruptcy estate."

        Anyone want to break the tie?

          Okay, I am just going to list the debtor's personal property and the joint property...and objections, your honor?

            ...very last question on Schedule B and I'll let this go:

            I know we listed the house on Schedule A - Real Property, but it would seem that it should also go on schedule B, since I will then reflect the $50K 'homestead' exemption on schedule B, right?

            Or so I not show it on Schedule B and just show the exemption on Schedule C...if that makes sense. ;)
