    60 day wait

    341 on Wed. and the report of no distribution was up on PACER today. So now we wait....... One last question for those who are knowledgeable. We are getting $8-12,000 back in taxes (haven't filed them yet) trustee didn't mention them but it wasn't listed as an exemption because we hadn't done them yet. We have enough to exempt them completely if needed. It's my understanding that they can change you to an asset case any time within the 60 days. If they do that on day 40 because they decide they want the taxes can my lawyer then file an amendment exempting them? The lawyer acted like it wasn't a big deal and he would amend to exempt if needed, I just wish we would have filed them earlier so they could have been listed on the exemption list from the get go. I know some peoples lawyers estimated what they would be but ours said they don't do that.

    Our lawyer acted like it wasn't big deal either but I insisted on exempting them. I just estimated what I thought we'd get back and put that down. I estimated 2k and we got back 1800 so I was close. I'd be kinda worried with that much cash coming back though.

      I am kinda nervous but as long as it can be amended if a problem comes up I will be able to relax some.

        If I were in this situation, I will amend my schedule to exempt the whole amount since you can before even filing your taxes. Why wait until they say something? the cost might be 29 dollars to amend but to guarantee to protect 12K...Why risk it?
        This Forum is better than any lawyer I met.
