OK, I really want to file today or tomorrow. I am currently having my wages garnished. Tomorrow is my pay-day, and although I know that tomorrow's paycheck will be garnished, my attorney said I can get that money back since we filed on/before that payday. But, he also told me that he can get the money back from the two previous paychecks, does that sound right to you? Also, I was not able to get my automatic deposit of my paycheck stopped, and it will be deposited tomorrow. I NEED to make my car payments out of that money. Should I plan on sending a check in the mail against the deposited paycheck in my checking account? Or do you think that even if I file today that the finance company will be able to take my payment over the phone? I fell behind due to my garnished wages, would like to attempt a ride through on the car. Any advice there?

Is your car financed at the same bank that you check is deposited in and is it a credit union? If so, if you could wait until that payment clears, open a acount at aother bank then file. If not, I don't understand the problem with filing and the car payment, I have driect deposit and it still is being deposited post filing. Don't know anything about garnishments but I have read on here that people get the money back from previous checks, might take a few days.
