    Well that wasn't so bad

    Had our 341. Gosh I'm glad that's over, it was much worse anticipating it than doing it. We got there and met up with our lawyer outside. I asked him 2 questions I've been wanting to ask but didn't want to have to do the whole relay with his assistant. One was about our income taxes since we will get between 8,000 and 12,000. We had talked to his assistant about it but I wanted to confirm with him that it was safe. He said that the trustee wouldn't bring it up and if he did we would amend to protect it. He said the trustee knows we have enough to protect it so won't even bother. I also had some questions about our car since I'm not sure if we want to keep it or not. So when we were done he said lets go inside. We sat down and the case they had going was a doozie. It was a business bankruptcy and while the trustee wasn't bad there was a lawyer there drilling the guy hard and it was obvious the guy was hiding money and assets and the lawyer was determined to get to the bottom of it. They went on forever and then finally another hearing was scheduled since they weren't getting anywhere. There was one couple in front of us and they were done in 2 minutes. Then us. They asked us all the same stuff they asked the couple before us. It was quick and painless. Then he said something about us having no money or assets for the creditors and that he would be filing it as a no assets case and we were done. The hardest part was finding a place to park with all the snow covering the meter spots. And hubby and I completely forgot that we had our turtle top on our van and so we couldn't get in the garages. We finally found a lot that was pay but outside but their machine to pay was broken and only took change so hubby walked to get some change while I waited so no one towed the van. Then we got to the courthouse and you couldn't take your cell phones in so we got some more exercise LOL. So now I have a question.... when would you file your taxes. Should we wait till it shows that it was filed as no assets on pacer or should we wait till discharge?

    I filed my taxes this year just after my discharge came through, but since I had exempted it I don't think it would have mattered. The only wrinkle I could think of is if the IRS wants to put a hold on it for some reason. Of course the sooner you file the sooner you could get that resolved.

      I had me refund exempted and filed right after 341. eletronic file direct depost had it in 7 days no problem.

        Now what happens if it is not actually listed under exemptions. Is it safe as soon as the trustee issues it's order of no distribution/ no assets? He can't come back after that wanting it right.
